Protorae Law is partnering with the Small and Emerging Contractors Advisory Forum (SECAF) to host their next GovCon CXO Forum, “Non-Solicitation and Non-Compete Provisions-Interpreting, Enforcing and Complying” on Wednesday, October 31st at 11:30 am.
“Non-solicitation” and “Non-Compete” provisions are part and parcel of the business of government contracts. These provisions can appear in non-disclosure agreements, employment agreements, teaming agreements, subcontracts and joint venture agreements, among others. These agreements also can include provisions which are not explicitly called “non-compete” or “non-solicitation” provisions but, in effect, operate as such. To further confuse matters, state law governs the interpretation and enforceability of these provisions and the law in this regard across different states is not always uniform.
